Contribute to ensuring the legal function is able to fulfil its goal of: “Driving achievement of Diageo’s strategic goals and our Performance Ambition and making a valuable contribution to Diageo’s long-term, sustainable success”, with primary accountability for leading and enhancing our investigation capabilities and building these capabilities in global function and market teams so that they can be conducted in an effective and cost efficient manner

Context/Scope:

  • Leader of the global investigation capability across Diageo and accountable for setting policy and standards on conduct of investigations, including ensuring alignment with regulatory and legal requirements and working closely with other Diageo Functions, including Business Integrity, Global Audit and Risk, Global Business Operations, Digital & Technology, HR, Brand Protection and with the Legal compliance specialists (who take the lead on investigations relating to potential breaches of key policies owned by the Legal Function, including Anti-Bribery & Corruption, Anti-Money Laundering, Antitrust and Data Privacy and on material regulatory investigations (e.g. tax investigations or trade loading allegations) which necessitate protection of legal privilege)
  • Provides strategic direction, global standards, support tools, capability training and performance monitoring on investigation processes and procedures to various in-market personnel conducting and managing investigations, including accountability for their functional capability development, to ensure they have the ability and capacity to deliver investigation support to the required standards

Financial:

  • Critical role in effectively managing the efficient provision of investigation support across Diageo to ensure that investigations are conducted on a timely and cost-effective basis

Market Environment/Complexity:

  • The role has a global remit, dealing with a great deal of market complexity since the investigative framework must take account of relevant local laws, regulations, standards and customs
  • The role holder will effectively manage investigation policies, standards and procedures, leading on all investigative matters, often relating to sensitive and challenging issues, and leading the necessary cross-functional approach to effective investigation activities, ensuring that experts are engaged at the appropriate time, in particular to ensure legal privilege protection in relation to investigation into matters where such protection is a necessity
  • Working closely with functional specialists, incl. BI, GAR, GBO, D&T, HR and Legal, as well as with global and market teams involved in conducting investigations into alleged breaches of Diageo’s Code of Business Conduct and other matters which require discreet investigative actions
  • The role-holder will need to be robust enough to deal with delicate situations, conflicting priorities and strong personalities while also maintaining a diplomatic balance

Leadership Responsibilities/ Key Stakeholders:

  • Own the investigative framework for Diageo by evolving and maintaining the policies, standards and procedures relating to investigations and reflecting best-practice for conduct of investigation activities;
  • Own and drive programmes to deliver a step change improvement of investigative standards across the business and demonstrate effective leadership of investigations at a global level to ensure that they are conducted in an effective, cost-efficient manner, using the appropriate resources and strategies
  • Build strong working relationships with other functions relevant to ensuring appropriate protection in relation to investigations, including BI, GAR, GBO, D&T, HR, Brand Protection and Legal
  • Establish strong relationships with and provide leadership to the global functions and market level teams involved in investigations; provide functional leadership to facilitate the sharing of best practice and building of capabilities; overseeing investigations in the markets and taking the lead on investigations involving complex multi-market issues or requiring more senior judgement and experience than held by the market investigation personnel
  • Support to Brand Protection; conduct significant BP investigations as required and collaborate with BP leadership on investigations capability development within Brand Protection.

Enabling achievement of Performance Ambition

  • Lead provision of pro-active and fit for purpose investigations management, advice and support at a global level, and support the wider Corporate Security strategy through communication of security policies, processes and guidelines, all in a manner that will enable achievement of the Ambition, including providing pro-active solutions to enable delivery of business objectives for the organisation
  • Define investigations strategy and policy and incorporate industry best practice for investigation management and provide reports on case analysis and investigative trends and direct investigative strategy appropriately and drive proactive programmes to mitigate current and emerging risks and trends
  • Lead provision of communication of policies, processes and guidelines and provide training to ensure compliance with operational processes and practices for investigation activities
  • Deliver a step change in investigative standards across Diageo and work proactively and collaboratively with senior stakeholders in BI, GAR, GBO, D&T, HR, Brand Protection and Legal and relevant business units to provide guidance, advice and support in the conduct of regulatory and compliance investigations, ensuring that Legal compliance specialists take the lead on investigations relating to potential breaches of key policies owned by the Legal Function, including Anti-Bribery & Corruption, Anti-Money Laundering, Antitrust and Data Privacy and on material regulatory investigations (e.g. tax investigations or trade loading allegations) which necessitate protection of legal privilege
  • Build and maintain an effective network of trained contacts across the business to ensure investigations are effective and timely and build and maintain effective contacts in relevant law enforcement, regulatory and industry bodies

Drive out costs to invest in growth

  • Ensure that all investigation management processes are optimised for maximum cost efficiency

Reputation Management

  • Drive the creation, embedding of great governance, effective compliance and risk management across the global function and market investigation teams, including managing issues to mitigate impact and risk by guiding resolution of issues and proactively creating an environment where reputational risk and other risks are avoided

Leadership & People Growth

  • Cultivate talent in the end-to-end corporate security function to create a super-engaged function, committed to personal growth and capability building, aligned behind / accountable for business performance, demonstrating the Behaviours in pursuit of enabling our Ambition
